The Institution of Lokayukta is very unique in as much as Lokayukta was intended with a view to ensure transparency in the matter of fact finding or in matters of inquiry/investigations to establish the truth of allegations of Corruption against the public functionaries punishable under the prevention of corruption ct,1988.In the case of a complaint of corruption before a police Thana, it is by way of making quires or interrogation and reflecting such findings in their report, whereas the procedure adopted in the Lokayukta board is based. The procedure carried out in Lokayukta provides not only for quires of interrogation by the Inquiring or the Investigating Officials but also contains provisions/procedures of giving an opportunity to the person concerned against whom the allegations have been made, offers opportunity to produce evidence and hearings either by himself/herself before Lokayukta is very similar to judicial processes of hearing parties, furnishing of evidence, records etc. and after detailed examination and hearing by Lokayukta a finding is given. The finding of Lokayukta is therefore strengthened by the process of investigation, inquiry hearing and therefore the finding of Lokayukta is very sound and cannot be assailed on flimsy ground.
The process of Lokayukta is significantly different from the procedure adopted by other investigating agencies or police in which case investigation or inquiry is usually headed by an Investigating officer either in the rank of Inspector Deputy Superintendent of police, or such other police officer of other rank may be engaged, whereas in Lokayukta the ultimate finding is done by Lokayukta headed by a former Chief Justice of High Court,
The process of inquiry or investigation reflects better procedure of experienced person to enquire or investigate the allegations that have been made. Therefore, the institution of Lokayukta was mooted with a view to ensure fair enquiry/investigation and also to ensure protection against malafide, fraudulent or frivolous complaints and also eliminate the chance of deficiencies or biased findings.
